Wild as the Moon App Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Wild as the Moon mobile application ("App"), including all content, features, and services made available through it. The App is operated by Wild as the Moon ("we", "us", or "our").
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.
1. Eligibility
You must be at least 18 years of age to create an account and use the App. By registering, you confirm that you meet this requirement and that all information you provide is accurate and complete.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share your login details with any other person or allow any other person to access the App using your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorised use of your account.
We reserve the right to suspend or terminate your account at our discretion if we reasonably believe that your account has been compromised or is being used in violation of these Terms.
3. Licence to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the App and its content for your own personal, non-commercial purposes.
This licence does not include the right to:
- Reproduce, distribute, publicly display, or make available any content from the App to any third party
- Modify, adapt, translate, or create derivative works based on any content within the App
- Use the App or its content for any commercial purpose
- Sub-license, sell, resell, or transfer your access to any other person
4. Intellectual Property and Trademarks
All content available through the App — including but not limited to text, graphics, images, audio, video, guided practices, written materials, templates, educational content, branding elements, and any other materials (collectively, "Content") — is the exclusive property of Wild as the Moon and is protected by copyright, trademark, and other intellectual property laws of England and Wales and international treaties.
Wild as the Moon™ and Wild Moon Portal™ are trademarks of Wild as the Moon. You may not use these marks or any confusingly similar marks without our prior written consent.
You acknowledge that no ownership of any intellectual property rights is transferred to you by virtue of these Terms or your use of the App. All rights not expressly granted herein are reserved by Wild as the Moon.
5. Content Restrictions
The Content provided through the App is intended solely for your personal use. You must not, under any circumstances:
- Copy, reproduce, download, screenshot, record, or capture any Content from the App for the purpose of sharing or distributing it
- Share, forward, repost, publish, or otherwise make any Content available to any person who does not have their own valid account
- Upload, post, or transmit any Content from the App to any website, social media platform, file-sharing service, messaging application, or any other medium
- Use any Content from the App in your own business, services, programmes, courses, or materials
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained within the Content
Any unauthorised use of the Content constitutes a breach of these Terms and may result in immediate termination of your account and legal action.
6. Community Guidelines
The App includes community features that allow you to post comments, share reflections, and interact with other members ("User Content"). By posting User Content, you agree to the following:
You retain ownership of your User Content, but you grant Wild as the Moon a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce your User Content solely in connection with operating and providing the App and its community features.
You agree not to post User Content that:
- Is abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable
- Infringes the intellectual property rights or privacy rights of any third party
- Contains spam, advertising, or solicitation of any kind
- Promotes violence, discrimination, or illegal activity
- Impersonates another person or misrepresents your identity
- Contains viruses, malicious code, or any harmful material
- Shares or reproduces any Wild as the Moon Content in a manner that violates Section 5 of these Terms
We reserve the right to remove any User Content and to suspend or terminate the account of any member who violates these guidelines, at our sole discretion and without notice.
Respectful participation. The Wild as the Moon community is a space rooted in mutual respect, kindness, and support. We expect all members to engage with one another in a manner that reflects these values. We reserve the right to moderate all community spaces and to take action as we see fit to maintain the integrity and safety of the community.
7. Privacy
Your privacy is important to us. By using the App, you consent to the practices described in our Privacy Policy.
8. Availability and Updates
We do not guarantee that the App will be available at all times or without interruption. We may, from time to time and without notice:
- Update, modify, or discontinue any features or Content within the App
- Perform maintenance that may temporarily affect access to the App
- Suspend or restrict access to all or part of the App
We will not be liable for any loss or inconvenience arising from any interruption, suspension, or modification of the App or its Content.
9. Third-Party Services
The App may contain links to third-party websites, applications, or services that are not owned or controlled by Wild as the Moon. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of any third-party service is at your own risk and subject to that third party's terms and policies.
10. Prohibited Conduct
When using the App, you must not:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorised access to the App, its servers, or any systems connected to the App
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Use any automated system, bot, scraper, or data mining tool to access, extract, or interact with the App
- Interfere with or disrupt the integrity or performance of the App
- Circumvent or attempt to circumvent any security features, access controls, or usage restrictions within the App
- Misrepresent your identity or impersonate any person or entity
11. Disclaimers
The App and its Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Content provided through the App is for general informational and personal development purposes only. It does not constitute professional medical, psychological, legal, or financial advice. You should always seek the guidance of a qualified professional before making decisions based on any Content within the App.
Wild as the Moon makes no representations or warranties regarding the accuracy, completeness, or reliability of any Content and shall not be held responsible for any actions taken based on such Content.
12. Limitation of Liability
To the fullest extent permitted by the laws of England and Wales, Wild as the Moon, its owner, and any associated parties shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the App, including but not limited to loss of data, loss of goodwill, or any other intangible losses.
Our total liability to you for any claim arising from or related to these Terms or the App shall be limited to the fullest extent permitted by law.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of England and Wales.
13. Indemnification
You agree to indemnify, defend, and hold harmless Wild as the Moon, its owner, and any associated parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your User Content, or your breach of these Terms.
14. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your licence to use the App and access its Content is immediately revoked.
You may stop using the App at any time. Sections 4, 5, 11, 12, 13, and 16 of these Terms shall survive any termination.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App following any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wild as the Moon in relation to your use of the App and supersede all prior agreements, understandings, and arrangements between you and us, whether oral or written.
